What is this Class Action about?
The class action alleges that Samsung Electronics America manufactured and sold camcorders containing an image sensor device known as a “CCD imager” that prematurely fails causing a blank or distorted screen that renders the device and the camcorder inoperable. The lawsuit further alleges that, despite scores of consumer complaints regarding the premature failure and defective nature of the products containing the defective CCD imager, Samsung has done nothing to provide a remedy or to accurately disclose the problem to its current and future customers. Rather, Samsung has concealed information about the defect while making misrepresentations to consumers in an attempt to cover up the problem. At the same time, Samsung has charged, and continues to attempt to charge, consumers $150 or more for “fixing” this known defect.
On July 26, 2007, the named Plaintiff, Russell Siegel, filed a class action lawsuit in the United States District Court for the Eastern District of Michigan (Case No. 07-13135, Hon. Paul Borman) on behalf of himself and other owners of affected camcorders to obtain monetary damages and to require Samsung to repair the affected camcorders.
